Adult-Use Marijuana Establishments
Application and Permitting Process for Adult-Use Marijuana Establishments and Medical Marijuana Treatment Centers
- Submit an application to the Community and Economic Development Department (CEDD) for a Host Community Agreement (HCA). The process of applying for an HCA is detailed in the Host Community Agreement (HCA) Policy and Procedures for Adult-Use Marijuana Establishments and Medical Marijuana Treatment Centers, available at the link to the left.
- Request a Zoning Report Form from the Building Department
- Visit the Town of Orange’s online permitting system at mygovernmentonline.org.
- Login or create an account.
- Under “Permits and Licensing” choose “Apply Online.”
- Select the correct country, state, and jurisdiction, then choose “Building Department” as the Project Type.
- On the next page, choose “Get Started on a New Application.”
- Choose “Zoning Report Form” as the Application Type and click “Next.”
- Enter the project address and other details as required.
- Upload plans and other files if needed.
- Once the application is complete, push “Submit” on the bottom of the screen.
- The Zoning Report Form will indicate if any additional permitting is required.
- Complete any additional permitting required by the Town, such as a Special Permit or Site Plan Review.
- Complete the CCC application process. The Town will certify to the CCC that the application is compliant with all municipal bylaws.
- The CCC issues a provisional license to the applicant.
- The applicant builds out the space. Work with the Town to apply for any Building Permits or similar that may be required.
- The Orange Building Department issues a Certificate of Occupancy to the applicant.
- Provide the Certificate of Occupancy to the CCC.
- The CCC issues the final license to operate.
- Apply for a business certificate through the Town Clerk's office.
Pursuant to MGL Chapter 94G, Section 3, the Town of Orange voted at the Special Town Meeting on December 6, 2018, to limit the number of Marijuana Retailers to 20% of the number of licenses eligible to be issued within the Town for the retail sale of alcoholic beverages not to be drunk on the premises where sold under MG: Chapter 138, Section 15. (Approved vote available in the sidebar). The number of licenses eligible to be issued is currently seven, so this limits the Town to no more than 2 Marijuana Retailers.
